“The Roberts Court and the Future of the Free Exercise and Establishment Clauses of the First Amendment”

FreeThe First Amendment is usually thought to have two clauses concerning religious freedom: the Free Exercise Clause and the Establishment Clause. With regard to both of these, the Roberts Court is in the process of remaking constitutional law. Professor Nelson Tebbe will explain these changes, including their likely trajectory in the future. He will discuss cases the Court just decided in June and July of 2020, cases it is about to decide in its coming term, and constitutional conflicts over free exercise and nonestablishment that have cropped up during the Covid pandemic.
